RULE ANALYSIS

Purpose of the rule or reason for the change:

The purpose of this amendment is to update notification procedures for Committee meetings to utilize the public meeting notice website.

Summary of the rule or change:

Change the procedure from send a notice of the meeting to a newspaper to post a notice on the public meeting notice website.

State statutory or constitutional authorization for this rule:

Section 63G-2-403

Anticipated cost or savings to:

the state budget:

None--Announcing the scheduling of meetings of the State Records Committee through the public meeting notice website will not change the cost of making public notifications.

local governments:

None--Local governments can access the public meeting notice website for no cost.

small businesses and persons other than businesses:

None--This method of notification through the public meeting notice website will not affect small business costs but should be a convenient way of accessing information about public meetings.

Compliance costs for affected persons:

None--This method of notification of meetings will not affect costs to individuals. It is available to anyone who has access to the internet.

Comments by the department head on the fiscal impact the rule may have on businesses:

RULE TEXT

R35. Administrative Services, Records Committee.

R35-1. State Records Committee Appeal Hearing Procedures.

R35-1-1. Scheduling Committee Meetings.

(1) The Executive Secretary shall respond in writing to the notice of appeal within five business days.

(2) Two weeks prior to the Committee meeting or appeal hearing the Executive Secretary shall post[send] a notice of the meeting on the Public Meeting Notice Web site.[to at least one newspaper of general circulation within the geographic jurisdiction.]

(3) One week prior to the Committee meeting or appeal hearing the Executive Secretary shall post a notice of the meeting indicating the agenda, date, time and place of the meeting at the building where the meeting is to be held and at the Utah State Archives.
