NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The rule is enacted under rulemaking authority granted to the Utah Division of Aging and Adult Services by Section 62A-3-104 and by the Older Americans Act, which requires the maintenance of a nutrition program for the elderly as a condition of the state receiving federal funding.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
As stated above, the state is required to create and maintain a nutrition program for the elderly in order to be considered a State Unit on Aging by the federal government and to continue receiving federal funding. Therefore, this rule should be continued.
