NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 53A-1-603(3) directs the Utah State Board of Education (Board) to adopt rules for the conduct and administration of the assessment programs. Subsection 53A-1-401(3) permits the Board to adopt rules in accordance with its responsibilities.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comment has been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
State law continues to direct the Board to adopt rules for the conduct and administration of assessment programs. The rule continues to provide necessary standards and procedures for school districts and charter schools to follow when administering standardized tests. Therefore, this rule should be continued.
