NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-1a-706(5)(b) requires the Utah State Board of Education to provide rules to establish timelines for payments to private schools. Section 53A-1a-707 requires the Utah State Board of Education to provide rules about eligibility of students for scholarships and application process for students to participate in the scholarship program.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The Utah Legislature continues to provide funding for the Special Needs Scholarship Program and Utah law continues to require that the Utah State board of Education provide rules to administration of the program. Therefore, this rule should be continued.
