NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 62A-7-104(3)(a) and Section 62A-7-202: The division is responsible to establish and administer statewide guidelines for admission to secure and home detention.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There are no written comments received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The division continues to use these guidelines as required to admit youth into secure detention facilities. Therefore, this rule should be continued. Nonsubstantive changes are forthcoming.
