Section 62A-1-111 authorizes the Department of Human Services to adopt rules, not inconsistent with law, as the department may consider necessary or desirable for providing social services.

There have not been any written comments since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is to be continued to implement provisions required by 45 CFR Part 164, subpart E, dealing with the treatment of certain individually identifiable health information held by the Department of Human Services.
