NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is enacted under the authority of Subsection 72-6-118(5) which requires the Utah Department of Transportation to make rules necessary to establish and operate tollways on state highways.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There have been no written comments received during and since the last five-year review of the rule from interested persons.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule should remain in effect to provide guidelines for tollway development agreements to establish tollways on state highways. Therefore, this rule should be continued.
