NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 53C-1-302(1)(a)(ii) and Title 53C, Chapter 2 et seq. authorize the director of the School and Institutional Trust Lands Administration to establish rules for the issuance of leases and management of trust-owned lands and resources.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments concerning this rule have been received by the agency since the previous five year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule provides the commodity-specific provisions for the leasing and management of geothermal steam resources on trust-owned lands throughout the State of Utah. It sets forth the guidelines and procedures whereby the agency may conduct business and that the customer may follow in relation to this resource. Therefore, this rule should be continued.
