Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 53A-1-401(3) authorizes the Utah State Board of Education to adopt rules in accordance with its responsibilities, and Subsection 53A-6-104(2)(a) authorizes the Board to rank, endorse, or classify licenses for educators.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comment has been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary because it provides criteria for local boards to employ educators in appropriate assignments so that local boards can receive state funding for appropriately qualified and assigned staff. Therefore, this rule should be continued.
