NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 31A-42-204 states that the commissioner shall approve the plan of operation created by the Risk Adjuster Board if it is consistent with Title 31A, Chapter 42, and is a reasonable administration of the risk adjuster.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The rule was recently updated, and no written comments were received during that process or previous to it.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule adopts the Risk Adjuster Board Plan of Operation, which details business rules for Avenue H transitional plans. Therefore, this rule should be continued. The board is set to expire 12/31/2018.
