NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 63G-6a-106(3) grants the Department authority to "make rules governing the procurement of highway construction or improvement." Subsection 72-6-107(2) mandates the Department perform acts for which this rule provides a procedure. This rule also sets forth the contracting requirements included in Section 63G-6a-1103.

The Department has not received any written comments since the last five-year review of the rule from interested persons supporting or opposing the rule.

The statutes listed above are still in effect and require the Department to maintain this rule. Therefore, this rule should be continued.
