NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is established pursuant to Subsections 63A-9-401(1)(a), 63A-9-401(1)(d)(v), 63A-9-401(1)(d)(ix), 63A-9-401(1)(d)(x), 63A-9-401(1)(d)(xi), 63A-9-401(1)(d)(xii), 63A-9-401(4)(ii), and 63A-9-401(6) which require the Division of Fleet Operations (DFO) to: 1) coordinate all purchases of state vehicles; 2) make rules establishing requirements for the procurement of state vehicles, whether for the replacement or upgrade of current fleet vehicles or fleet expansion; 3) make rules establishing requirements for cost recovery and billing procedures; 4) make rules establishing requirements for the disposal of state vehicles; 5) make rules establishing requirements for the reassignment and reallocation of state vehicles; and 6) make rules establishing rate structures for state vehicles.

There have been no written comments received during and since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The legislative direction for the rule still exists. Therefore, this rule should be continued.
