Subsection 36-11-404(1) explicitly requires this rule: "The lieutenant governor shall make rules that provide: (a) for the appointment of an administrative law judge to adjudicate alleged violations of this section and to impose penalties under this section; (b) procedures for license applications, disapprovals, suspensions, revocations, and reinstatements that comply with the procedures and requirements of Title 63G, Chapter 4, Administrative Procedures Act."

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Statute requires this rule in order to provide procedures for issuing lobbyist licenses, disapproving lobbyist license applications, suspending and revoking lobbyist licenses, reinstating lobbyist licenses, and appointing administrative law judges. Therefore, this rule should be continued.
