NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is enacted under the authority of Subsection 63A-5-103(1)(e), which directs the Utah Building Board to make rules necessary for the discharge of duties of the Division of Facilities, Construction and Management (DFCM); and Section 63A-5-211 regarding the Planning Fund.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

DFCM and the Utah Building Board have not received written comments, either in support or opposition to Rule R23-3.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Keeping Rule R23-3 is necessary to provide the policies and procedures for the authorization, funding, and development of programs for capital development and capital improvement projects and the use and administration of the Planning Fund. Therefore, this rule should be continued.
