NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 26-8a-105, Department Powers, states that the department shall: "(4) adopt rules...to: (a) license ambulance providers and paramedic providers; (b) permit ambulances and emergency response vehicles; (c) establish application, submissions, and procedural requirements for licenses, designations, certificates, and permits; and (d) establish and implement the programs, plans, and responsibilities as specified in other sections of this chapter."

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

Public comment usually reflects rates should be lower. Fiscal reporting and comment from agencies indicate the rates are fair. Changes have been suggested and included as part of the amendment process as directed by the department based on past comments, and amendments to the actual rates and charges will continue to be made as economic factors change.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is a basis for establishing statewide maximum rates and charges for ambulance and paramedic services. The process for fair and equitable rates is used by the Department for this purpose. Therefore, this rule should be continued.
