NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is required by Subsection 62A-5-103(2)(b) which directs the Division to establish standards for protecting the rights of people with disabilities receiving Division funded services.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The Division must have procedures and standards to protect the rights of persons with disabilities who apply for or receive Division services as required by Subsection 62A-5-103(2)(b). Therefore, this rule should be continued.
