NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-1-401(3) allows the Utah State Board of Education to adopt rules in accordance with its responsibilities. Subsection 53A-1a-106(2)(b) directs local boards of education to establish policies for the implementation of students education plans (SEPs) or student education/occupation plans (SEOPs). This rule provides standards and procedures for school board implementation of the required plans under the Comprehensive Counseling and Guidance Program.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to provide standards and procedures for school boards to implement SEPs or SEOPs under the Comprehensive Counseling and Guidance Program. Therefore, this rule should be continued.
