NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The department is given authority to charge weights and measures registration fees, and is given a mandate to establish rules for registration, as follows: Subsection 4-9-15(1)(a) pursuant to Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the department shall establish rules providing for the registration of weights and measures users and issuance of certification of weights and measures devices to ensure the use of correct weights and measures in commerce or trade. In Subsection 4-9-15(1)(i)(i), the department may, as provided under Subsection 4-2-2(2), charge the weights and measures user a registration fee.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
To date, the Department has not received written comments regarding this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The original justification for this rule, to register all devices in the state so that they can be regulated effectively, still exists. An entire database has been constructed and maintained for this purpose. Therefore, this rule should be continued.
