NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Program is authorized by Subsection 4-18-5(e) which authorizes the Conservation commission to approve and make loans for agricultural purposes, from the Agriculture Resource Development Fund for projects designed to enhance agricultural efficiency and conserve resources. This rule clarifies the program and explains the responsibilities of the parties involved.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no specific written comments received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The program is ongoing, growing, and successful. It provides a benefit to the agriculture community, the economy of the state and the environment. Therefore, this rule should be continued.
