NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Title 73, Chapter 10c, authorizes the Department of Environmental Quality acting through the Drinking Water Board to issue loans to political subdivisions to finance all or part of drinking water project costs and to enter into "credit enhancements", "interest buy-down agreements", and "hardship grants".
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received either in support or opposing this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Through this rule the Drinking Water Board is able to provide grants and low interest loans to communities for construction of drinking water infrastructure projects. Without this funding many communities could not afford to construct drinking water system improvements that are necessary to protect the health and safety of the public. This program also provides matching funds for the annual federal EPA Capitalization Grants, which provide millions of dollars annually to the Drinking Water State Revolving Fund (SRF) program and for continued administration of the federal and Utah State Safe Drinking Water Acts. Therefore, this rule should be continued.
