NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 41-12a-803(7) directs the Department of Public Safety to make rules and establish procedures to use the Uninsured Motorist Database for the purposes stated in Subsection 41-12a-803(1): verify compliance with motor vehicle owner's or operator's security requirements, reduce the number of uninsured vehicles, increase compliance with motor vehicle registration and sales and tax laws, protect financial institutions bona fide security interests, and identify and prevent identity theft and other crimes.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule should be continued because it is a statutory requirement and there is an existing contract with a third party vendor to provide this program. In addition, the information provided by this program is used on a daily basis by law enforcement, the Driver License Division, and the Department of Motor Vehicles. The program has been successful in reducing the number of uninsured registered motor vehicles in Utah.
