NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 65A-8-207(1) authorizes the Division of Forestry, Fire and State Lands to make rules to administer the Wildland Suppression Fund. Subsection 65A-8-205(2) (b) describes the conditions where by a county is not required to pay an assessment for an acre of real property.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Participating counties are assessed a fee to be part of the Wildland Suppression Fund based on the number of acres of unincorporated land within the county and the taxable value of real property on those lands. Not all unincorporated lands within a county are susceptible to wildland fire. Therefore, these areas can be exempted from being assessed a fee. This rule outlines procedures a county must follow in order to exempt an area from the Wildland Suppression Fund. It also defines the conditions an area must meet in order to qualify for an exemption. Therefore, this rule should be continued.
