NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Section 41-6a-1011, which states at (2)(b): "Authority to operate a pedestrian vehicle on public highways or sidewalks shall be granted according to rules promulgated by the commissioner of public safety."

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments or concerns have been received by the agency.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The statute recognizes that there are cases where disabled or handicapped individuals have personal transportation needs. This rule establishes the parameters by which permission can be granted for the operation of very specific vehicles. This same permission can be suspended, revoked, or denied in the interest of public safety. The rule outlines the adjudicative proceedings associated with granting and removal of that. Therefore, this rule should be continued.
