NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is enacted under Section 41-22-8, Registration Fees. This rule establishes a fee and any increase in fees requires legislative action. This rule also allows for the fee not be charged to a United States Government owned or operated off-highway vehicles (OHVs) within Utah. The fees are set by the Board with the amount not to exceed $17 for registration, a $3 fee for each duplicate registration card, and a $5 fee for each duplicate registration sticker.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been submitted over the last five years that either support or oppose the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The Division has a legal requirement to establish a registration fee for any and each registered OHV within Utah. This registration fee allows the Division to pursue and adopt a safety and education program, promote safety, and protection for people, the environment with the use and operation, and equipment associated with OHV, and to develop trails and other facilities for the use of OHVs. Therefore, this rule should be continued.
