This rule governs program eligibility, benefits, and administration by the Department for the Ryan White HIV/AIDS Treatment Modernization Act of 2009 Part B Program (Ryan White Program). It is authorized by Section 26-1-5, Section 26-1-15, Section 26-1-18, and Subsections 26-1-30(2)(a), (b), (c), and (g).

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have not been any written comments received since the rule was enacted.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The purpose of this rule is to provide reimbursement to providers for services rendered to HIV positive individuals who meet specific eligibility requirements. The standards outlined in the rule describe Ryan White Program eligibility, benefits, and administration.
