Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-1a-602(5) authorizes the Job Enhancement Committee to make a rule to establish policies and procedures for awards and scholarships in accordance with prioritized critical areas of need as determined by the committee, timelines for the submission and approval of applications, and the distribution of the awards and scholarships to successful applicants based on available money provided by legislative appropriation.

No written comment has been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to be necessary because it provides procedures for participation in the Public Education Job Enhancement Program. There was no new money for Public Education Job Enhancement Program as of March 2011, but remaining funds continue to be distributed and monitored for previously identified educators. Therefore, this rule should be continued.
