NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

The authority for this rule is under Subsection 76-8-311.1(1)( c)(2), which establishes that a law enforcement facility may be declared a secure facility.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No public comments regarding this rule have been received since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule was intended to regulate the possession of firearms in the Peace Officer Standards and Training Facility. Since the original rule was adopted, the training facility has moved into a mixed purpose building with more open public access. The change in facility has made this rule obsolete and it is the intention of the division to repeal this rule. Therefore, this rule should be continued until the repeal can be processed.
