NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 4-5-17 is the authority to make and enforce rules. (1) The department may adopt rules to efficiently enforce this chapter, and if practicable, adopt rules that conform to the regulations adopted under the Federal Food, Drug and Cosmetic Act, 21 U.S.C. Sec. 301 et seq. This statue allows the Utah Department of Agriculture and Food to adopt the Interstate Shellfish Shipper Model Ordinance: 2005 edition Recommendations of the United States Public Health Service/Food and Drug Administration.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments opposing or supporting this rule have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule was promulgated at the request of Utah's seafood distribution industry to enable them to export shellfish to other states. The rule is still required in order for them to conduct this portion of their business. Therefore, this rule should be continued.
