NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is adopted pursuant to the authority of Subsection 65A-1-4(2), which requires the Division to promulgate rules, and by Section 65A-8a-101 et seq., to clarify the procedure through which operators must register with the Division and notify the Division of the intent to conduct forest practices. Also, pursuant to the authority of Subsection 65A-8a-106(3), which requires the Division to promulgate rules, to clarify the procedure for application, approval, implementation, and monitoring of Forest Stewardship Plans.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No supporting or opposing written comments have been received since the last notice of continuation.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule complies with statute by clarifying the procedure through which operators must register and notify the Division of the intent to conduct forest practices. The provisions in this rule are effective in providing the requirements, procedures, and standards for managing forest practices. The rule also clarifies that the Division is responsible for accepting application, evaluating for approval, implementing, and monitoring Forest Stewardship Plans. Therefore, this rule should be continued.
