NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 77-27-7 states that the Board can establish hearing dates and cause the offender to appear before the Board; and Section 77-27-9 establishes criteria for parole proceedings. Rule R671-309 is enacted under these provisions.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule fulfills due process requirements for fair hearings. Therefore, this rule should be continued.
