NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 26-1-15 authorizes the Executive Director of the Department of Health to accept federal funding to operate the Women, Infants, and Children (WIC) program in Utah. 7 CFR part 246 is the set of federal regulations under which the Utah WIC program operates, and these regulations require that Utah implement state specific policies to operate the program. Pub. L. No. 95-627 requires that the Utah State WIC Office in cooperation with participating local agencies publicize the availability of WIC program benefits to offices and organizations that deal with significant numbers of potentially eligible persons.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
Comments were requested from the Utah Association of WIC Administrators (UAWA), the WIC Advisory Council, and the health officers of the local health departments in regards to the five-year review of this rule. No comments favoring or opposing continuation of this rule were received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule was reviewed during 2011 and was found to be current and accurate. This rule is needed to regulate the administration of the WIC program within the local health departments. Therefore, this rule should be continued.
