NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Subsections 53A-1-402(1)(b) and (c) which direct the Utah State Board of Education (Board) to make rules regarding competency levels, graduation requirements, curriculum, and instruction requirements, and by Subsection 53A-1-401(3) which allows the Board to adopt rules in accordance with its responsibilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comment has been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to be necessary because state law requires the Board to adopt rules regarding competency levels, graduation requirements, curriculum, and instruction requirements and this rule provides standards and procedures required by state law. Therefore, this rule should be continued.
