NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 40-6-5 provides for rulemaking authority to the Board of Oil, Gas and Mining and provides the Board with the authority to regulate all operations related to the production of oil and gas and the disposal of salt water and oil field wastes. This statute authorizes the board to adopt rules for reporting and the division is the repository for these records.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is necessary for the division to carry out the requirement to collect appropriate information from parties in the oil and gas industry and then make available to the public. This rule is necessary for consistency in data collection and data publication. Therefore, this rule should be continued.
