NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is enacted under the authority of Section 72-11-210 wherein the Passenger Ropeway Safety Committee is authorized to make rules requiring registration of passenger ropeways, establishing standards, and outlining procedures for inspection and enforcement.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments from interested persons received during and since the last five-year review of the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should remain in effect to enable the Passenger Safety Ropeway Committee to fulfill its purposes in safeguarding the life, health, property, and welfare of citizens using passenger ropeways, through registration, inspection and enforcement of the standards adopted in the rule. The ski industry is the major operator of passenger ropeways and has been supportive of this rule. Therefore, this rule should be continued.
