NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 34A-1-104 gives the Labor Commission authority to establish rules to administer the Workers' Compensation Act and the Occupational Disease Act.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received during the last five-year review period.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

In light of the Commission's continuing responsibility to administer Utah's workers' compensation system, it remains necessary for the Commission to address a wide variety of administrative issues, such as definition of terms, designation of official forms, payment standards, and processing of claims. It is also necessary for the Commission to address methods for proof of claims and to establish the amount of certain benefits, such as burial expenses. Therefore, this rule should be continued.
