NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Sections 9-8-305 and 9-8-404 mandate the preservation and protection of all antiquities, historic and prehistoric ruins, historic sites, buildings, and objects. Subsections 53C-1-302(1)(a)(ii) and 53C-2-201(1)(a) authorize the Director of the School and Institutional Trust Lands Administration to prescribe the management of those cultural resources on trust lands.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received by the agency regarding this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
As required by statute, this rule provides the guidelines whereby the School and Institutional Trust Lands Administration manages the cultural resources on trust lands in compliance with Subsection 9-8-305(2) and Section 9-8-404. Therefore, this rule should be continued.
