Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Sections 53-8-204 and 53-8-205, which authorize the department to set procedures for the safety inspection program. Section 41-6a-1601(2) authorizes the department to make rules setting minimum standards covering the design, construction, condition, and operation of vehicle equipment for safely operating a motor vehicle on the highway.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The safety inspection program requires specific procedures to operate the program. This rule lists those requirements. Therefore, this rule should be continued.
