NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 62A-3-107 authorizes the division to use rules to establish procedures and policies. Home and Community-Based Alternatives Services are part of the services provided in accordance with Section 62A-3-104 and the Older Americans Act, Title III B and Title III D. This rule clarifies the policy and procedures for implementing these services.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This program is still actively administered by the Division and Area Agencies and requires the policies contained in this rule to be in place. Therefore, this rule should be continued.
