NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Section 7-1-309 expressly authorizes the Commissioner of Financial Institutions to conduct hearings relating to matters within his supervisory jurisdiction.

No supporting or opposing written comments have been received by the agency concerning this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Section 7-1-301 affords the commissioner the functions, powers, duties, and responsibilities with respect to institutions, persons, or businesses subject to the jurisdiction of the department. The rule lists the types of hearings the commissioner may call in connection with any matter pending before the department and how those hearings should commence. It also covers confidential proceedings, pleadings, discovery, and subpoenas, and should be continued.
