NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is enacted under the general rulemaking authority of Section 72-12-201 which authorizes the department to make rules for the administration of its programs including road maintenance, snow removal, and requiring safety devices as authorized in Sections 72-3-102, 41-6a-302, and 41-6a-1636.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no comments received from interested persons during and since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should continue in effect so the department can adequately meet its obligation to safely maintain and control use of state highways by imposing travel restrictions including requiring the use of snow tires or chains when and where conditions warrant it.
