NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is enacted under the general rulemaking authority found in Section 72-1-201 and under the specific authority granted the department by Section 54-4-14 regarding safety functions of railroads.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There have been no comments received from interested persons during and since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule should continue in effect so the department can meets its obligation to regulate safety functions of railroads as authorized by Section 54-4-14 and Section 72-1-201 by incorporating federal standards which contribute to public safety.
