NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 23-20-12 authorizes the Wildlife Board to adopt rules specifying terms and conditions whereby an individual, who is validly licensed to hunt may be authorized to hunt from a vehicle. Section 23-19-36 allows a resident who is blind, paraplegic, or permanently disabled to receive a license to fish upon satisfactory proof to the Division of Wildlife Resources. This rule specifies terms, conditions, and the process for providing proof of a disability, respectively.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments supporting or opposing Rule R657-12 have been received since 09/10/2007, when the rule was last reviewed.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The standards and procedures adopted in Rule R657-12 have worked well in providing fairness to all concerned individuals. The provisions of this rule have provided an effective and efficient process for persons to obtain a certificate of registration for taking wildlife from a vehicle and persons to obtain a fishing license as authorized under Subsection 23-19-36(1). Continuation of this rule is necessary for continued success of the program.
