NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 53A-19-105(5) requires the Utah State Board of Education (Board) to develop standards for defining and aiding financially distressed school districts and Subsection 53A-1-401(3) permits the Board to adopt rules in accordance with its responsibilities.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comment has been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is continued because it provides necessary procedures to specify eligibility requirements for nonrecurring or nonroutine interfund transfers for financially distressed school districts.
