NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Title 35A, Chapter 8, Part 7, as amended (the Act) is the enabling legislation of Utah Housing Corporation (UHC). Section 35A-8-711 of the Act grants UHC the power to adopt, amend, and repeal rules. Section 35A-8-712 of the Act states that UHC shall make rules governing the activities authorized by its enabling legislation.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

UHC has received no comments, either written or verbal, supporting or opposing the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It is necessary to continue this rule to provide the public with a clear statement of the procedures required for petitions for declaratory orders with regard to the applicability of rules, statutes, and orders governing or issued by UHC.
