NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
In Subsection 73-18-15.2(7)(a) "The division may collect fees set by the Utah State Parks and Recreation board in accordance with Section 63J-1-504 from each person who takes the division's boating safety course to help defray the cost of the boating safety course", the legislature gives the State Parks Board authority to set boating safety course fees. This rule is the boards' rule for fees associated with our boating education courses.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There have been no written comments concerning Rule R651-227 in the last five years.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The funds collected under this rule help the division provide a boating education program for the boaters of the State of Utah. A portion of this program provides mandatory (statutory) education for youth operating personal watercraft. The fees specifically cover the costs of materials and the mailing of the course certificates. Therefore, this rule should be continued.
