NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 73-10-4 authorizes the Board of Water Resources to pursue the development of the waters of Utah, which includes at times selecting private consultants as defined in Section 58-22-102.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
When private consultants are needed for the design and construction of water projects, it is necessary to have guidelines in place to govern the selection process and the negotiation of contracts for the work required. Therefore, this rule should be continued.
