NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 19-1-106 created the Radiation Control Board within the Department of Environmental Quality. Subsection 19-3-104(4) provides that the Board may make rules necessary for controlling exposure to sources of radiation that constitute a significant health hazard and to meet the requirements of federal law relating to radiation control.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

This rule has not been controversial. There have been very few amendments to Rule R313-15 since the last five-year review and no comments were submitted about each amendment. The Division of Radiation Control Director has recommended to the Radiation Control Board that this rule be continued.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is continued because it establishes the standards for protection against ionizing radiation. The requirements are necessary to control the receipt, possession, use, transfer, and disposal of sources of radiation by a licensee or registrant so that the total dose to an individual, including the doses resulting from all sources of radiation other than background radiation, do not exceed established safety standards. The rule is also needed to meet the Utah's commitment, as an Agreement State with the U.S. Nuclear Regulatory Commission (NRC), to maintain regulatory compatibility with the NRC.
