NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized under: Section 63G-3-201, based upon this rules impact upon "a class of persons"; Section 64-13-10, outlining the duty and authority to establish rules to accomplish the purpose of correctional programs; and Section 64-13-39.5, outlining definitions related to the care of chronically or terminally ill offenders.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No correspondence has been received by the Utah Department of Corrections regarding this rule since it was enacted.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The conditions which require this rule are still in effect. The rule is for the public's notice and facilities which care for the prison's chronically ill. Therefore, this rule should be continued.
