NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53B-2-106 authorizes Rule R805-1 by authorizing the president of each higher educational institution, with approval of that institution's board of trustees, to enact rules for administration and operation of the institution. Section 53B-3-101 authorizes Rule R805-1 by allowing the Board of Regents to pass rules and regulations governing parking and traffic on campuses and related facilities and to enforce the rules and regulations by all appropriate methods; Section 53B-3-101 further allows the Board of Regents to delegate this same authority to the president of each institution so long as the rules and regulations are approved by the institution's Board of Trustees.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The University of Utah's ability to ensure the safety of all persons on campus has been facilitated by Rule R805-1. Rule R805-1 regulates the operation of bicycles, skateboards, and scooters on campus and provides clear standards on the proper operation of such means of transportation. Rule R805-1 further gives the University of Utah the ability to sanction students, staff, and faculty who are in violation of this rule. Therefore, this rule should be continued.
