NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 34A-1-104 gives the Labor Commission authority to establish rules to administer and enforce all laws for the protection of the life, health, and safety of employees. Section 40-2-401 authorizes the Commission to certify individuals involved in coal, gilsonite, or other hydrocarbon mining pursuant to rules established by the Commission.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received during and since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

In light of the Commission's continuing certification of individuals involved in Utah's coal, gilsonite/hydrocarbon mining industries, continuation of this rule remains necessary. The Commission has received no comments in opposition to this rule.
